GCMD/IDN WEB SERVICE USAGE POLICIES


Prior to providing the GCMD CEOS/IDN Metadata Web Service, which would provide metadata content to an individual  or organization, the potential collaborator must read and agree to abide by the "Web Services Terms of Use" as  characterized in the GCMD CEOS/IDN Governance document.   The "GCMD CEOS/IDN Governance" documents the  standards by which the collaborating project/organization staff members will abide when requesting and subsequently  using the "Metadata Web Services"  provided through NASA.  However, resources to support the distributed search are  limited and therefore priorities will be made as follows:  

(1)  requests made through supporting NASA HQ official;   
(2)  requests made through contributing partner;
(3)  requests made through GEOSS.

Terms of Use

By using this Web Service, you agree to the following terms.

1. Provisions on Services.  Through the Global Change Master Directory (GCMD) and the Committee on Earth Observation Satellites’ (CEOS) International Directory Network (IDN), hereafter referred to as the “GCMD/IDN Metadata Web Service”, access to the Metadata Web Service and its content (as defined below) according to the terms below may be granted.
a) The GCMD/IDN cooperates with external organizations and will provide access to the API directly to known collaborators.  These collaborators should not serve as secondary providers for access to the GCMD/IDN content.  It is inappropriate to subsequently share information about this web service to other individuals or organizations.   
b) The GCMD/IDN is constantly innovating in order to provide the best possible experience for its users.  Potential collaborations acknowledge and agree that the form and nature of the Services, which the GCMD/IDN provides, may change from time to time without prior notice.
c) As part of this service, you acknowledge your understanding that the GCMD/IDN may stop (permanently or temporarily) providing the Services (or any features within the Services) to you or to users generally at the provider’s sole discretion, without prior notice to you.  You may stop using the Services at any time.  (Please notify us if you no longer plan to use the service.) 
d) All content will be served directly from the GCMD/IDN metadata web service.   We strongly discourage any local caching of the content by participating services.
e) You acknowledge and agree that while the GCMD/IDN may not currently have set a fixed upper limit on the number of transmissions you may send or receive through the Services or on the amount of storage space used for the provision of any service, such fixed upper limits may be set by an IDN representative at any time, at the discretion of management.
e) Resources to provide assistance are limited.  We are not able to provide immediate or extended assistance.

2. Restrictions on Use.  Without prior written authorization from a GCMD/IDN representative, you may not:
(a) copy, translate, modify, or make derivative works of the content or any part thereof;
(b) redistribute, publish, sell, assign, lease, market, transfer, or otherwise make the Content subsequently available to third parties;
(c) reverse engineer, decompile or otherwise attempt to extract the source code of this Service or any part thereof;
(d) use the services in a manner that gives you or any other person access to mass downloads or bulk feeds of any content.
(e) delete, obscure, or in any manner alter any content or associated warning, notice or link that appears in the service or science content;

3. Appropriate Conduct; Compliance with Law.  You agree that you are responsible for the GCMD/IDN content while using these services and for any consequences associated with your access.  You agree to use the Service only for purposes that are legal, proper and in accordance with the Terms and any applicable policies or guidelines made available. By way of example, and not as a limitation, you agree that when using the Services or the Content, you will not:
(a)   Violate the legal rights (such as rights of privacy and publicity) of others;
(b)   Publish any inappropriate, defamatory, obscene, or unlawful content;
(c)   Publish any content that infringes any patent, trademark, copyright, trade secret or other proprietary right of any party, unless you are the owner of the rights, or have the permission of the owner or other legal justification to use such content;
(d)   Impersonate another person or entity, or falsify or delete any author attributions or proprietary designations or labels of the origin or source of content, software or other material;
(e)   Restrict or inhibit a user from using  the GCMD/IDN services;
(f)   Disrupt IDN services, servers, or networks connected to GCMD/IDN services, or disobey any requirements, procedures, policies or regulations of networks connected to GCMD/IDN services;
(g)   Implement and incorporate any robot, spider, site search/retrieval application, or other device to retrieve or index any portion of the IDN services or content, or collect information about users for any unauthorized purpose;
(h)  Submit content that falsely expresses or implies that such content is sponsored or endorsed by GCMD/IDN;
(i)   Transmit any viruses, worms, defects, Trojan horses, or any items of a destructive nature.
(j)   Circumvent or otherwise attempt to leverage your privileges to access or modify the metadata content for which you do not have authorization.

4. Content in the Products. By using these services, the GCMD/IDN content contributors retain all ownership rights.  You may not use, access or allow others to use or access the content in any manner not permitted under the Terms, unless you have been specifically permitted to do so by the owner of that content, in a separate agreement that has been acknowledged by the GCMD/IDN.  A portion of the content is provided under designated restrictions from third parties and is subject to intellectual property rights.
